  1. None of the Assistant Attorney General’s caselaw citations as cited in her “Memorandum of Points and Authorities…” have any relevance to the defendant’s three Habeas Corpus petitions, and have merely been intended to manipulate the court into making improper findings.
  2. None of the defendant’s three Habeas Corpus petitions are barred by the Federal one year statue of limitations under 28 U.S.C. ss 2244 (D). Contrary to the claims of opposing counsel, all three Habeas petitions in question have been timely filed in both state and Federal court.
  3. The Habeas Corpus petition regarding a conviction occurring on March 15th, 1994. (02-1155).
  4. The Habeas Corpus petitions regarding two convictions occurring on December 29th, 1998. (02-1225 / 02-1226)
  5. The defendant has a right to, and requests, evidentiary hearings to prove his claims.
