CONCLUSION

WHEREFORE  for the reasons stated and argued above, the defendant prays that this honorable court grant the defendant the following relief in relation to this Memorandum of law, and “motion to dismiss” issue:

1. DENY the state’s motion to dismiss case no. 02-1155-PA (PLA), as no grounds exist to deny Federal review.
2. DENY the state’s motion to dismiss case no. 02-1225-PA (PLA), as no grounds exist to deny Federal review.
3. DENY the state’s motion to dismiss case no. 02-1226-PA (PLA), as no grounds exist to deny Federal review.
4. GRANT the defendant’s request, and to forthwith schedule and set three evidentiary hearings, for the three petitions.
